MURPHY BEACH, Fla. (WFLA) – A federal appeals court in North Carolina has ruled that the state of Florida is in violation of the U.S. Constitution because they are not doing anything to protect public health.

The ruling is a win for those in the public health community who believe a state’s refusal to implement medical marijuana laws is not only wrong, but dangerous.

Florida is one of 20 states in the country to require patients with cancer or AIDS to use medicinal marijuana or undergo a high-powered dose of chemotherapy.

At least one doctor is worried about what this ruling could mean for patients with chronic pain.

“It’s an issue that we all know that will become a lot easier if we actually allow patients with cancer to choose how they want to treat it. That’s an issue that could make a huge difference to hundreds and hundreds of thousands of people that go in for treatment of this condition and how they want to manage that,” said Dr. Peter Oreskes, an emergency room doctor who is an instructor at the University of Florida’s Center on Law and Health.

The ruling by the U.S. Court of Appeals for the 11th Circuit has been widely criticized as a victory for medical marijuana advocates and patients’ rights, but not for medical marijuana advocates.

Cannabis was officially legalized in Colorado and Washington state in 2012. There, there are several doctors and researchers in Colorado who think it’s an effective medical use for marijuana that provides pain relief and helps relieve muscle spasms, nausea, pain, and nausea and vomiting.

However, in this case, the ruling is a victory for people like Dr. William McBride, who suffers from multiple sclerosis.

McBride’s story is not unusual.
